You must notify us immediately if you decide to cancel your order, preferably by phone, and quote your order number or cancel the order on the Mobile Application. If we accept your cancellation, no cancellation fee applies. If the Goods have been prepared or processed for delivery or have already been dispatched, it may not be cancelled. We will not be able to refund for any order, which has been already dispatched.
We will cancel the order if the Goods ordered are not available for any reason. We will notify you for such cancellation by way of a Non-acceptance Message and return any payment that you have made in this regard on the Mobile Application.
If the cancellation was made in time and in accordance with this Clause 5, we will refund the full amount within 14 (fourteen) days.
In the unlikely event that you have been delivered with wrong items other than the Goods ordered, you have the right to reject the delivery of the wrong item and you shall be fully refunded for the ordered item.
Where we have requested any information from you in order to deliver the Goods ordered, you agree to facilitate such delivery and provide us with accurate and complete information.
You authorize us to use, store or otherwise process your personal information in order to provide deliver the Goods to you and for the purposes of marketing or publicizing information with respect to notifying any offers or discounts

Adequate care has been taken to ensure that the information available on this Mobile Application is correct and error free. However, we cannot warrant that use of the Mobile Application will be error free or is fit for the purpose, or is timely, or that the defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Mobile Application and we do not make any warranty whatsoever, whether express or implied, relating to fitness for purpose, or accuracy.
By accepting these terms of use you agree to relieve us from any liability whatsoever arising from your use of any information provided on the Mobile Application or made available from any third party, or your consumption of any Goods from a Participating Restaurant
We disclaim any and all liability to you for the delivery of the Goods ordered to the fullest extent permissible under applicable law. This does not affect your rights as a consumer. If we are found liable for any loss or damage to you such liability is limited to the amount you have paid for the relevant Goods or Services. We cannot accept any liability for any loss, damage or expense, including any direct or indirect loss such as loss of profits to you, howsoever arising. This limitation of liability does not apply to personal injury or death arising as a direct result of our negligence
We do not accept any liability for any delays, failures, errors or omissions or loss of transmitted information, viruses or other contamination or destructive properties transmitted to you or your mobile phone via our Mobile Application.
We shall not be held liable for any failure or delay in performing Services or delivering Goods where such failure arises as a result of any act or omission, which is outside our reasonable control such as unprecedented circumstances, overwhelming and unpreventable events caused directly and exclusively by forces of nature that can be neither anticipated, nor controlled, nor prevented by the exercise of prudence, diligence, and care, including but not limited to: war, riot, civil commotion; compliance with any law or governmental order, rule, regulation or direction and acts of third parties ( “Force Majeure” ).
If we have contracted to provide identical or similar orders to more than one Consumer and are prevented from fully meeting our obligations to you by reason of an event of Force Majeure, we may decide at our absolute discretion which orders we will fulfill by providing delivery and to what extent.
The Goods delivered by us are provided for private domestic and end consumer use only. Accordingly, we do not accept liability for any indirect loss, consequential loss, loss of data, loss of income, loss of profit, damage to property and/or loss from claims of any third parties arising out of the use of the Mobile Application or for any Goods or Services.
We have taken all reasonable steps to prevent internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, we cannot be held liable in the unlikely event of a breach in our secure computer servers or those of third parties.
In the event MARUTHI CABShas a reasonable belief that there exists an abuse of vouchers and/or discount codes or suspects an instance of fraud, MARUTHI CABSmay cause the Consumer to be blocked immediately and reserves the right to refuse future service. Additionally, should there exist an abuse of vouchers or discount codes, MARUTHI CABSreserves the right to seek compensation from any and all such Consumers.
Offers are subject to MARUTHI CABS's discretion and may be withdrawn at any time and without notice.
All prices are in INR only.
We may subcontract any part or parts of the Services or Goods that we provide to you from time to time and we may assign or novate any part or parts of our rights under these Terms and Conditions without your consent or any requirement to notify you.
We may alter or vary the Terms and Conditions at any time without notice to you.
Payment must be made either at the time of ordering the Goods by credit card/debit card/ mobile wallet on MARUTHI CABS’s Mobile Application/at the time of delivery by cash. Failure to pay on time will result in the cancellation of your order.
Do not use or launch any automated system or program in connection with our Mobile Application or its online ordering functionality
Do not collect or harvest any personally identifiable information from the Mobile Application, use communication systems provided by the Mobile Application for any commercial solicitation purposes, solicit for any reason whatsoever any users of the Mobile Application with respect to their submissions to the Mobile Application, or publish or distribute any vouchers or codes in connection with the Mobile Application, or scrape or hack the Mobile Application.
The Terms and Conditions together with the Privacy Policy, any order form and payment instructions constitute the entire agreement between you and us. No other terms whether expressed or implied shall form part of this Agreement. In the event of any conflict between these Terms and Conditions and any other term or provision on the Mobile Application, these Terms and Conditions shall prevail.
If any term or condition of our Agreement shall be deemed invalid, illegal or unenforceable, the parties hereby agree that such term or condition shall be deemed to be deleted and the remainder of the Agreement shall continue in force without such term or condition.
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. The parties hereto submit to the exclusive jurisdiction of the courts of India.
No delay or failure on our part to enforce our rights or remedies under the Agreement shall constitute a waiver on our part of such rights or remedies unless such waiver is confirmed in writing.
All dealings, correspondence and contacts between us shall be made or conducted in the English language
By accepting these terms of use, you agree to relieve us from any liability whatsoever arises from the use of information from any their party or consumption of any food or beverages from a participating restaurant.
Maruthi Cabs cabs reserves the right to collect user data including name, contact information and other details to facilitate services or use of its platform to avail services. All information collected from the user are on a bonafide basis. Misuse and misrepresentation of identity or contact details will lead to automated termination of services or the use of the platform without prior notice to such users.
User accounts bearing contact number and email IDs are created and owned by Maruthi Cabs cabs. Any promotional discounts, offers and reward points in the form of Maruthi Cabs Money accumulated can be revoked without prior notice in the event of suspicious account activity or malafide intent of the user.
In the case where the system is unable to establish unique identity of the user against a valid mobile number or e-mail ID, the account shall be indefinitely suspended. Maruthi Cabs cabs reserves the full discretion to suspend a user's account in the above event and does not have the liability to share any account information whatsoever.
Most content and some of the features on the web site are made available to visitors free of charge. However, MARUTHI CABS CABS reserves the right to terminate access to certain areas or features of the web site at any time for any reason, with or without notice. MARUTHI CABS CABS also reserves the universal right to deny access to particular users to any/all of its Services without any prior notice/explanation in order to protect the interests of MARUTHI CABS CABS and/or other visitors to the web site. MARUTHI CABS CABS reserves the right to limit, deny or create different access to the web site and its features with respect to different user(s), or to change any of the features or introduce new features without prior notice.
The following Terms & Conditions shall apply to customers / passengers utilising the Services offered by the Company for the hiring of taxis:
The customer shall pay the taxi fare (as displayed in the meter), parking charges, additional night surcharge (where applicable) and any fee or levy presently payable or hereinafter imposed by the law or required to be paid for availing of the taxi Services.
The customer agrees and accepts that the use of the Services provided by the Company is at the sole risk of the Customer, and further acknowledges that the Company disclaims all representations and warranties of any kind, whether express or implied.
The customer shall ensure that he/she will not indulge in any of the following activities while in a taxi
Smoking or consuming any kind of intoxicants inside the Taxi. The driver has the right to refuse the pick-up or ask the customer to alight the cab if the customer is found to be in an intoxicated state or is found misbehaving with other passengers or the driver, or is causing a nuisance.
Littering the Taxi
Soiling or damaging the seats and/or any other interiors of the Taxi.
Misusing, soiling or damaging any of the devices (technical/non-technical) in the taxi.
Asking the driver to break any Traffic/RTO/City Police and/or government rules for any purpose (especially reaching the destination earlier). The driver has the right to refuse such a request by the customer. The driver also has the right to refuse such a pick-up or ask such customer(s) to alight from the cab.
Asking the driver to board more than 4 adults in the taxi. The rules under which the taxi Services are provided by the Company, stipulate that a maximum of 4 adult passengers shall be allowed per trip. In view of this, the customer shall not pressurize the driver to allow more than 4 adult passengers in the taxi. The driver has the right to refuse such a pick-up or ask such customer(s) to alight from the cab.
Pressurizing the driver to overload the boot space of the taxi with luggage. The customer shall not be generally allowed to use the seating area of the taxi for placing any kind of luggage.
The customer agrees and acknowledges that the use of the Services offered by Company is at the sole risk of the customer and that Company disclaims all representations and warranties of any kind, whether express or implied as to condition, suitability, quality, merchantability and fitness for any purposes are excluded to the fullest extent permitted by law.
Without prejudice to the above, the Company makes no representation or warranty that
the Services will meet the customer's requirements;
the Services will be uninterrupted, timely, secure, or error-free.
The Company shall not be responsible or liable for any loss or damage, howsoever caused or suffered by the Customer arising out of the use of taxi service offered by Company or due to the failure of Company to provide Services to the Customer for any reason whatsoever including but not limited to the Customer's non-compliance with the Services' recorded voice instructions, malfunction, partial or total failure of any network terminal, data processing system, computer tele-transmission or telecommunications system or other circumstances whether or not beyond the control of Company or any person or any orgMaruthi Cabszation involved in the above mentioned systems.
The Company will not be liable for any damages of any kind arising from the use of the Service offered by the Company, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
There shall be extra charges for far off locations & toll charges as well.
If any passenger if misses the train or flight or bus, Company will not be liable for any compensation. The customer shall make an alternate arrangement if the cab has not reached due to any reason.
The Customer shall indemnify Company from and against and in respect of any or all liabilities, losses, charges and expenses (including legal fees and costs on a full indemnity basis) claims, demands, actions and proceedings which Company may incur or sustain directly or indirectly from or by any reason of or in relation to the use or proposed use of the Services by the Customer and shall pay such sums on demand on the Company
• The Company is hereby authorized to use the location based information provided by any of the telecommunication compMaruthi Cabses when the Customer uses the mobile phone to make a taxi booking. The location based information will be used only to facilitate and improve the probability of locating a taxi for the Customer.
• The Company shall be entitled to disclose to all compMaruthi Cabses within its group, or any government body as so required by the law or by directive or request from any government body, the particulars of the Customer in the possession of Company in any way as Company, in its absolute discretion, deems fit or if it considers it in its interests to do so.
The Company shall be entitled at any time without giving any reason to terminate the booking of taxis done by the Customer.
The Company encourages all its customers to take full responsibility of his/her items. In case of lost items inside the Company during the journey, Company will try to locate the items on a "best-effort" basis but is not responsible for the same in case of loss or damage to the same.
If the Customer leaves any goods in the taxi or has any complaint in respect of the Services or the use of the taxi, the Customer has to inform Company of the same in writing within 24hours of using the taxi or the Services of Company.
The Company shall not be liable for any conduct of the drivers of the taxis. However, the Company encourgaes you to notify it of any complaints that you may have against the driver of any taxi that you may have hired using the Company's Services.
The Company shall be entitled to add to, vary or amend any or all these terms and conditions at any time and the Customer shall be bound by such addition, variation or amendment once such addition, variation or amendment are incorporated into these terms and conditions at Company's website at www.Maruthi Cabs cabs.in.com on the date that Company may indicate that such addition, variation or amendment is to come into effect
All the calls made to the Company's call centre are recorded by the Company for quality and training purposes
All vehicles registered with the Company are continuously tracked using GPS for security reasons only. It is expressly made clear to you hereby that the Company does not own any taxis nor does it directly or indirectly employ any drivers for the taxis. Taxis and drivers are all supplied by third parties and the Company disclaims any and all liability in respect of the drivers and the taxis alike.
The Company have right to use the customer contact information for its own marketing purposes. The Company may send regular SMS updates to the mobile numbers registered with it.
The courts of Mumbai, India shall have the sole and exclusive jurisdiction in respect of any matters arising from the use of the Services offered by Company or the agreement or arrangement between Company and the Customer.
The above mentioned terms and conditions of use and/or Agreement and the Privacy Policy constitute the entire agreement between the User(s) and MARUTHI CABS CABS with respect to access to and use of the web site and the Services offerred by MARUTHI CABS CABS, superseding any prior written or oral agreements in relation to the same subject matter herein.
